We wish to inform You that Legislative Decree n. 196 of 30th June 2003 ("Italian Personal Data Protection Code") protects the personal data of the people and other subjects in the processing of personal data. Your data will therefore be processed according to principles of fairness, lawfulness, transparency and protection of your privacy and rights.

Consequently, in accordance with Section 13 of Legislative Decree n. 196/2003, we inform You that:

1. The personal data supplied will be processed exclusively for the following purposes:

1.1 Purposes necessary to the fulfillment of your request, to the execution of the present agreement and to the management of the purchasing order:

• Promotion and selling of the services and products requested;
• Activities concerning the service or product supplied;
• Management of payments, recovery of credits and bookkeeping;
• Registration of data;
• Statistical reports and customer satisfaction surveys - concerning the quality of the services supplied and SierraSoft activity - carried out autonomously or by companies specialized in the sector.

Should the information not be conferred, this could mean the impossibility to supply the services.

1.2 Purposes concerning our activity such as:

• Marketing researches, economical and statistical analyses,product and service marketing;
• Forwarding info/promotional material about products or services, initiatives and news concerning SierraSoft and its group.

Such activities can concern products and services of our company and its group.

Consent for the processing of personal data for the above-mentioned purposes is faultative and can be revoked at any time. The absence of consent will determine the possibility to benefit from the services specified at point 1.1 but it will be impossible to process the data for the purposes specified at the present point.

2. The information will be processed by using paper and/or electronic means and by employing procedures that ensure compliance with the related law.

Personal data will be communicated by the company to other entities or categories of entity if provided for by the law. Consequently, data can be communicated to:

• To the people in charge of data processing in our company (e.g. administrative and bookkeping department, management of information systems, market analyses and researches, budget certifications),always for the expressed purposes;
• To banks and/or companies specialized in credit collection or payments derived from the execution of contracts;
• To workmen supplying goods and services included in the contract, with the purpose of fulfilling the obligations provided for by the law.

In SierraSoft Your personal data will be processed by the employees in charge of Customer Care, Marketing, Invoicing and Technologies. Such employees, operating under the control of the "Data Processor", have been designated "Persons in Charge of the Processing" and have received operative instructions for the purpose.

3. The "Data Controller" is sierraSoft S.r.l., with its head office in Via Roveredo, 1/A - 33170 Pordenone - Italy

4. At any time You may exercise your rights according to Sec. 7 of Legislative Decree 196/2003, reported below:

Art. 7 - Diritto di accesso ai dati personali ed altri diritti

• L'interessato ha diritto di ottenere la conferma dell'esistenza o meno di dati personali che lo riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile.
• L'interessato ha diritto di ottenere l'indicazione:
• dell'origine dei dati personali;
• delle finalità e modalità del trattamento;
• della logica applicata in caso di trattamento effettuato con l'ausilio di strumenti elettronici;
• degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai sensi dell'articolo 5, comma 2;
• dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere comunicati o che possono venirne a conoscenza in qualità di rappresentante designato nel territorio dello Stato, di responsabili o incaricati.
• L'interessato ha diritto di ottenere:
• l'aggiornamento, la rettificazione ovvero, quando vi ha interesse, l'integrazione dei dati;
• la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati;
• l'attestazione che le operazioni di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato.
• L'interessato ha diritto di opporsi, in tutto o in parte:
• per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché pertinenti allo scopo della raccolta;
• al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione commerciale.
